We are happy to cancel and refund any orders providing the modelling work has not been initiated, as we understand personal circumstances many change from time to time. If the work has been initiated, the total amount refundable will be dependent upon the stage of the work;
Before the artist commences work; we will refund you 100% of the order.
After the artist commences work but prior to SHIPMENT; we will refund you 50% of the order.
After the model has been shipped; NO REFUNDS at this point.
All finished products are an artistic impression of the photographed subject and are therefore non-refundable in accordance to the Distance Selling Regulations.
We will be willing to replace anything that has been damaged due to defect or shipping as long as it is reported to us within 48 hours of receiving the product. We will need a photograph of the defect and in addition the product returned to process to the refund.
All refunds for damages are discretionary and do not affect your statutory rights.
All models are handcrafted, hand painted and hand packed. There is a total of 5 different points of QC checks along the process to ensure your mini sidekick reaches you in the condition it was meant to.
We commit ourselves to in providing you with a QUALITY service and will furnish you with a finished product within 3 weeks upon receiving an appropriate photograph. Sometimes due to unforeseen circumstances, this may be delayed.
FunCreations.co.uk will not be held responsible for any loss or damage(s) or delay of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to FunCreations.co.uk
These terms above shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall they exclude or limit FunCreations.co.uk liability for death or personal injury resulting from neither its negligence nor any fraudulent representation.
FunCreations.co.uk will not be liable in any amount for failure to perform any obligations under this agreement if such failure is caused by occurrence of any unforeseen event beyond its reasonable control including without limitation internet outages, communication outages, fire, flood, war or act of God.
Subject as aforesaid, to the maximum extent permitted by law, FunCreations.co.uk excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to FunCreations.co.uk and FunCreations.co.uk shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
any incorrect or inaccurate information on FunCreations.co.uk;
any interruptions to or delays in updating FunCreations.co.uk or the sub-domain(s), external domain(s) or thereof;
any loss or damage resulting from your use of the inability to use the FunCreations.co.uk web site or resulting from unauthorised access to, or alteration of your transmission or data in circumstances which are beyond our control;
any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something FunCreations.co.uk have done wrong;
any amount or kind of loss or damage due to viruses or other malicious software that may infect a users computer equipment, software, data or other property caused by persons accessing, using or downloading FunCreations.co.uk, or from transmission via emails or attachments received from FunCreations.co.uk.
